The processing of and access to employee’s occupational health information are statutorily controlled through Health Health-, Labour Labour-and Information Laws.
The Promotion of Access to Information Act, 2000 (‘PAIA’) has applied for a number of years.
The Protection of Personal Information Act, 2013 (‘POPIA’) applies to occupational health information from the 1st of July 2021 and imposes considerable additional requirements and mandatory actions on employers and on occupational medicine practitioners.
Session 1 – The overall requirements of POPIA and the resulting action plan for occupational health
Session 2 – The impact of POPIA on the ‘Medical record’ requirements of Occupational Occupational-& Health Legislation and the HPCSA rules.
Session 3 – The action plan for implementation of POPIA in occupational health practices and the changes which need to be made to the occupational medicine practitioner’s PAIA Section 51 Manual.
